Do employers have to pay time-and-a-half on holidays?
There are currently 14 U.S. federal holidays: New Year’s Day, MLK Day, Presidents Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving, and Christmas.
Government workers get the day off, but many people in the private sector have to work. Are these workers legally entitled to time and a half pay? In general, the answer is no. There is no federal law that requires employees to be paid overtime for working on holidays. However, some states and cities may have their own laws.
Even when it's not required, many businesses choose to pay extra for working on holidays. It depends on the business. For example, Starbucks pays time-and-a-half for seven holidays while Walmart doesn't pay extra for any, even Christmas!
Do employees get time-and-a-half on Sundays?
Not usually. There is no federal law that requires overtime for working on Sundays, although in very rare cases a city or state may require it. Rhode Island, for example, requires certain workers to be paid overtime on Sundays.
Do I get overtime for working more than 40 hours?
It depends. According to the Fair Labor Standards Act (FLSA), employees who are paid by the hour typically must get 1.5 times their normal pay (time-and-a-half) if they work more than 40 hours in a week. For example, if a person works 50 hours, they would get 40 hours at their normal rate, plus 10 hours at time-and-a-half.
However, many employees are exempt. Employees who are paid a salary instead of by the hour typically do not earn overtime.
